Motion To Suppress Evidence
The fact that the officer did not have proper grounds to conduct a traffic stop is one of the best defenses that can be used to fight a DUI charge.
If the judge hearing your case is convinced of this though proper motion practice, your case can be dismissed without need for a trial.
Scientific Defense of Rising Blood Alcohol
The law requires your blood level be below .08% while you are behind the wheel. Before or after driving, your blood alcohol level is irrelevant. If you can prove that while you were driving your alcohol level is below the required 08% your case can be dismissed.
We can have an expert witness testify on your behalf in many cases. This will depend on the pattern of consumption. Even though you were tested above the .08% threshold, at the time you were behind the wheel you may have actually been below.
With a scientific background, Paul J. Adras understands not only the law, but understands the science involving blood alcohol levels. He has learned to analyze chemicals using the same techniques used by law enforcement officials. Paul J. Adras has earned a Bachelor’s Degree in Biological Science with a minor in Chemistry.
